Terms for Adding Your AllSouth Debit Card to a Third-Party Digital Wallet:
These Terms and Conditions for Adding Your AllSouth Debit Card to a Third-Party Digital Wallet (the “Terms”) apply when you add your AllSouth Debit Card (the “Debit Card”) to a digital wallet, mobile wallet, or other digital payment service operated by a third party (the “Wallet”). Throughout these Terms, the words “you” and “your” refer to the cardholder of the Debit Card, and the words “we,” “us,” and “our” refer to AllSouth Federal Credit Union.
The agreements, disclosures, and other terms that govern your Debit Card remain in full force and effect after you add your Debit Card to a Wallet. The Wallet provides only an additional method of accessing and using your Debit Card. Your use of the Debit Card, including transactions conducted through a Wallet, remains subject to the terms and conditions of your Membership Disclosure and your Electronic Funds Transfer Agreement and Disclosure, each as amended from time to time.
Please review those agreements carefully, as they contain important information regarding your rights, responsibilities, and obligations relating to the use of your Debit Card and transactions conducted through a Wallet. By adding your Debit Card to a Wallet, you acknowledge and agree to be bound by these Terms, as amended from time to time. If you do not agree to these Terms, you should not add your Debit Card to a Wallet.
By adding your AllSouth Card to a Wallet, you agree to these Terms:
1. Adding Your AllSouth Debit Card to a Wallet. To add your Debit Card to a Wallet, you must follow the instructions provided by the Wallet provider. Not all Debit Cards are eligible to be added to a Wallet. We reserve the right, in our sole discretion, to determine whether your Debit Card is eligible for enrollment in a Wallet and to suspend, restrict, or terminate your ability to use your Debit Card with a Wallet at any time and for any reason.
We may take these actions, for example, if we suspect fraud or unauthorized activity involving your Debit Card; if your Debit Card account is delinquent, overdrawn, or otherwise not in good standing; if applicable laws, regulations, or network rules change; or if we are directed to do so by a Wallet provider or an applicable payment card network, such as Visa.
We do not charge any fees for adding your Debit Card to a Wallet. However, the Wallet provider or other third parties, such as wireless carriers, mobile device providers, or data service providers, may charge fees in connection with your use of a Wallet or your mobile device. You are solely responsible for any such fees.
2. Using a Wallet. A Wallet may enable you to create a virtual representation of your Debit Card on your eligible mobile device. The Wallet may allow you to make contactless payments at merchants’ point-of-sale terminals or other payment devices that accept contactless payments or transactions. Once you have added your Debit Card to a Wallet, you may use the Wallet to conduct transactions wherever the Wallet is accepted. The Wallet may not be accepted at all locations where your Debit Card is accepted. In addition, certain merchants may require a physical presentation of your Debit Card or your government-issued identification to complete a transaction, including transactions exceeding certain dollar amounts.
3. AllSouth is Not Responsible for Wallets. AllSouth is not the provider of any Wallet, and as such, is not responsible for providing the Wallet to you. We are responsible solely for supplying information securely to the Wallet provider to enable the use of your Debit Card within the Wallet. AllSouth is not responsible for the performance or nonperformance of any Wallet, Wallet provided, mobile device, wireless carrier, or other third party or for any failures, security failures, errors, delays, interruptions, or other issues arising from your use of a Wallet. We are also not responsible for any agreement, terms, conditions, policies, or disclosures that you enter into or accept with a Wallet provider or any other third party in connection with the Wallet.
4. Contacting You Electronically. By adding your Debit card to a Wallet, You acknowledge and agree that we may contact you electronically, including by email, text message, in-app notification, or other electronic means, regarding your Debit Card, transactions involving your Debit Card, your use of a Wallet, to the extent permitted by applicable law. You agree to maintain a current and valid email address and other contact information with us and to promptly notify us of any changes to such information.
5. Removing Your AllSouth Debit Card from a Wallet. You may remove your Debit Card from a Wallet at any time by following the instructions provided by the applicable Wallet provider.
6. Ending or Changing These Terms. We reserve the right to modify, amend, supplement, discontinue, or terminate these Terms, or to discontinue offering or supporting a Wallet, at any time and for any reason, subject to applicable law. If required by applicable law, we will provide notice before of any material change to these Terms of the discontinuation of our support of a Wallet. Your continued use of your Debit Card through any Wallet after we have made any changes to these Terms, constitutes your acceptance of the Terms.
7. Disclaimer of Warranties; Limitation on Liability. The Wallet is provided by a third-party Wallet provider and not by AllSouth Federal Credit Union. We do not own, control, operate, or maintain any Wallet and are not responsible for the performance, availability, security, or functionality of any Wallet or any products or services offered by a Wallet provider. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL REPRESENTATIONS, WARRANTIES, AND CONDITIONS OF ANY KIND (EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITENSS FOR PARTICULAR PURPOSE, TITLE, AND NONINFRINGMENT OF PROPRIETARY RIGHTS) AS TO ANY AND ALL WALLETS AND ALL INFORMATION, PRODUCTS, AND OTHER CONTENT INCLUDED IN OR ACCESSIBLE FROM ANY WALLET. EXCEPT AS OTHERWISE PROVIDED BY LAW, IN NO EVENT SHALL ALLSOUTH FEDERAL CREDIT UNION, ITS SUBSIDIARIES, AFFILIATES, AGENTS, EMPLOYEES, OR REPRESENTATIVES BE LIABLE FOR DEATH, PERSONAL INJURY, PROPERTY DAMAGE, OR ANY INCIDENTAL, SPECIAL, INDIRECT, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF OR DAMAGE TO DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL OR FINANCIAL DAMAGES, LOST REVENUES, OR OTHER LOSSES OF ANY KIND, ARISING OUT OF THESE TERMS OR IN ANY WAY RELATED TO YOUR USE OR INABILITY TO USE ANY ALLSOUTH CARD IN CONJUNCTION WITH A NON-ALLSOUTH WALLET, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE ABOVE STATED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
8. Indemnification. You shall indemnify and hold AllSouth, its licensors, sponsors, agencies and its subsidiaries, affiliates, officers, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of (i) your use of any Debit Card and the Wallet or (ii) any breach of the terms and conditions set forth in these Terms by you, your authorized users of the Wallet using your Debit Card, or your credentials. You agree to cooperate with us, as reasonably requested, in connection with the investigation, defense, or resolution of any such claim.
9. Privacy and Security. Your privacy is important to us. Our Online Privacy Policy, available at www.allsouth.org, as amended from time to time, applies to your use of your Debit Card in connection with a Wallet.
You acknowledge and agree that we may share information about you and your Debit Card with the Wallet provider, merchants, payment networks, and other parties as necessary to provide the services you have requested, process transactions, provide information regarding your transaction history, and improve our ability to provide such services.
AllSouth does not own, operate, or control the Wallet and is not responsible for the privacy, security, or confidentiality of any information maintained by the Wallet provider. You should review the Wallet provider’s privacy policy and other applicable terms and conditions before using the Wallet. If you do not agree to the Wallet provider’s privacy policy or terms, you should not use the Wallet.
You are responsible for maintaining the confidentiality of your user IDs, login IDs, passwords, device credentials, and any other security information used to access your Wallet or conduct transactions using your Debit Card. By using a Wallet, you acknowledge that if you share such credentials with another person, that person may be able to access your Wallet, make transactions using your Debit Card, and obtain personal information associated with your Wallet.
If you permit another person to use your Wallet, user ID, password, device, or any other security credentials, you are responsible for any and all transactions that person authorizes or conducts using your Debit Card through the Wallet.
Your Membership Disclosure and Electronic Funds Transfer Agreement and Disclosure require you to notify us promptly if you believe there is an error involving your Debit Card, your Debit Card transitions, or if you suspect unauthorized use, fraud, or theft. We will investigate and resolve any error or unauthorized transaction in accordance with those agreements and applicable law.
Except as expressly provided in your Membership Disclosure, Electronic Funds Transfer Agreement and Disclosure, Debit Card Disclosure, or as otherwise required by applicable law, we are not liable for any loss, injury, or damages you may incur in connection with your use of a Wallet.
10. Governing Law and Disputes. These Terms are governed by the laws of the State of South Carolina, without regard to conflicts of law’s provisions. Any disputes arising from these Terms shall be governed by the dispute resolution provisions contained within your Membership Disclosure, as amended from time to time.
11. Questions. If you have any questions, disputes, or errors about the Wallet, please contact the Wallet provider. For questions, disputes, or errors related to your AllSouth Debit Card or your AllSouth Debit Card transactions, please contact us.
